1. Agreement to Terms
These Terms and Conditions (“Terms”) govern your use of the website https://kmlheatingair.com (the “Site”), your purchase of HVAC products and services from KML Heating and Air (“KML,” “we,” “us,” or “our”), and your participation in our SMS/text messaging program. By accessing the Site, requesting service, or providing your phone number to us, you agree to be bound by these Terms. If you do not agree, do not use our Site or services.

2. Services Offered
KML Heating and Air provides residential and commercial HVAC services throughout Central and West Central Florida, including but not limited to:
- Air conditioning repair, installation, and replacement
- Heating system repair and installation
- Heat pump services
- Ductless mini-split installation and service
- Indoor air quality solutions (UV lights, air purifiers, duct cleaning, humidity control)
- Preventative maintenance and seasonal tune-ups
- Emergency HVAC service
Services are subject to availability, technician scheduling, and geographic service area.
3. Estimates, Pricing, and Payment
- Service calls start at $89 (subject to change; current rate confirmed at time of scheduling).
- All work performed beyond a diagnostic service call requires written or verbal customer approval of an itemized estimate before work begins.
- Quoted prices are valid for 30 days unless otherwise stated.
- Payment is due upon completion of service unless prior written financing arrangements have been made.
- We accept major credit cards, debit cards, cash, check, and approved financing.
- Returned checks are subject to applicable fees under Florida law.
- Past-due balances may accrue interest at the maximum rate permitted by Florida law and may be referred to collections.
4. Warranties
KML Heating and Air honors all applicable manufacturer warranties on equipment we install. KML also provides a workmanship warranty as specified in your individual service agreement or invoice. Warranty coverage does not extend to damage caused by:
- Misuse, neglect, or improper operation
- Acts of God (hurricanes, lightning, floods, power surges)
- Unauthorized modifications or repairs by third parties
- Failure to perform recommended routine maintenance
- Pre-existing conditions disclosed prior to service
Full warranty terms are provided in writing at the time of installation or service.
5. Cancellation and Rescheduling
- Customers may cancel or reschedule scheduled appointments without charge up to 2 hours prior to the appointment window.
- Cancellations within 2 hours of the scheduled appointment, or refusal of entry upon technician arrival, may incur a trip charge.
- KML reserves the right to reschedule appointments due to emergencies, weather, or technician availability and will notify you as soon as practicable.
6. SMS / Text Messaging Terms (A2P 10DLC Compliant)
By providing your mobile number to KML Heating and Air, you expressly consent to receive SMS/MMS text messages from us in accordance with the following terms:
1. Program Name: KML Heating and Air SMS Program (Operated by KML Heating and Air)
2. Program Description: We send text messages related to:
- Appointment confirmations and reminders
- Technician arrival / on-the-way notifications
- Service status updates and follow-ups
- Quote and invoice notifications

3. Opt-In: You opt in by providing your mobile number through our website, in person, by phone, by signing a service agreement, or by texting our business number. Consent is not required as a condition of purchasing any goods or services.
4. Opt-Out: Reply STOP to any message at any time to unsubscribe. You will receive a one-time confirmation that you have been opted out, after which no further messages will be sent unless you re-subscribe.

6. Message Frequency: Frequency varies based on your interactions and service activity with KML Heating and Air.

8. Carrier Disclaimer: Carriers (AT&T, Verizon, T-Mobile, US Cellular, Sprint, Boost, Cricket, MetroPCS, and others) are not liable for delayed or undelivered messages.
9. Privacy: Your privacy is important to us. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy for full details.
10. Eligibility: You must be at least 18 years of age and the account holder of the mobile number (or have authorization from the account holder) to opt in to our SMS program.
11. Compliance: Our SMS program complies with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and A2P 10DLC carrier requirements.
7. Use of the Site
You agree to use the Site only for lawful purposes. You may not:

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW OR EXPRESSLY PROVIDED IN A WRITTEN SERVICE AGREEMENT OR MANUFACTURER WARRANTY. KML DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
KML does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KML HEATING AND AIR, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SITE OR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE; OR (D) ANY OTHER MATTER RELATING TO THE SITE OR SERVICES.
KML’s total cumulative liability for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to KML for the specific service giving rise to the claim.
Nothing in this section limits liability that cannot be lawfully limited under Florida law.
11. Indemnification
You agree to indemnify, defend, and hold harmless KML Heating and Air, its officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your violation of any law or third-party right; or (c) your misuse of the Site or services.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms, the Site, or our services shall be resolved exclusively in the state or federal courts located in Pasco County, Florida, and you consent to personal jurisdiction and venue in those courts.
13. Dispute Resolution
Before initiating any formal legal action, you agree to first contact us at KML.Heating.Air@gmail.com or 352-737-1850 to attempt informal resolution. Both parties agree to make good-faith efforts to resolve disputes within 30 days of written notice.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any written service agreements or invoices, constitute the entire agreement between you and KML Heating and Air with respect to the Site and services, and supersede all prior agreements or communications.
